Service Agreement
BESMANI – CUSTOMER SERVICE AGREEMENT
This Customer Service Agreement (“Agreement”) is entered into between Besmani (“Besmani,” “we,” “us,” or “our”) and the customer (“Client,” “you,” or “your”) who purchases services directly from Besmani through Besmani.com, Beauty.Besmani.com, or related platforms (collectively, the “Platform”).
By placing an order, confirming a payment plan, or clicking “I Agree”, you accept and agree to be bound by this Agreement, the Terms & Conditions, and the Privacy Policy (collectively, the “Platform Agreements”).
1. SCOPE OF SERVICES
1.1 Services Provided
Besmani provides professional services which may include, but are not limited to:
- Website design and development
- Digital marketing and advertising
- Branding and creative services
- AI-powered tools or automation
- Consulting, strategy, and technical support
The specific scope, deliverables, and pricing are defined in:
- The order summary
- Proposal
- Invoice
- Or written agreement approved by the Client
1.2 No Guaranteed Results
You acknowledge that:
- Results depend on many factors beyond Besmani’s control
- Besmani does not guarantee specific business outcomes, revenue, rankings, or performance metrics
2. CLIENT RESPONSIBILITIES
The Client agrees to:
- Provide accurate and complete information
- Deliver required content, materials, approvals, and feedback in a timely manner
- Respond to communications reasonably and professionally
- Ensure that any provided content does not violate third-party rights or laws
- Delays caused by missing or late Client input may affect timelines and delivery.
3. PROJECT TIMELINE & DELIVERY
3.1 Start of Work
Work begins only after:
- The initial payment (or first installment) is received
- Required materials or access are provided
3.2 Timeline Estimates
Timelines are estimates unless explicitly stated otherwise
Delays caused by Client actions do not constitute breach by Besmani
4. PAYMENT TERMS
4.1 Pricing & Fees
Prices are agreed at checkout, proposal approval, or invoice
All fees are in U.S. dollars unless otherwise stated
4.2 Payment Methods
Online payment may not be available. Payments may be completed via:
- Phone payment
- Check
- Other approved offline methods
4.3 Installments & Milestones
If an installment plan is selected:
- Payments may be divided into milestones (e.g., prepayment, delivery, review, completion)
- The total must equal 100% of the agreed amount
- Work may pause if a payment is late or unpaid
4.4 Late or Failed Payments
Besmani reserves the right to:
- Suspend services
- Delay delivery
- Terminate the Agreement for non-payment
5. REVISIONS & CHANGE REQUESTS
5.1 Included Revisions
- Revisions included are based on the selected package or agreement
- Revisions must align with the original scope
5.2 Scope Changes
Requests that exceed the agreed scope may:
- Require additional fees
- Require a revised timeline
- Be subject to written approval before work continues
6. CLIENT APPROVAL & ACCEPTANCE
6.1 Review Period
Upon delivery, the Client is responsible for reviewing work and providing feedback within a reasonable timeframe.
6.2 Acceptance
If no feedback is provided within the agreed or reasonable period:
- The work may be considered accepted
- The project may proceed to the next phase or completion
7. OWNERSHIP & INTELLECTUAL PROPERTY
7.1 Ownership Transfer
Upon full payment:
- The Client receives ownership of the final deliverables
- Ownership applies only to the completed and paid-for work
7.2 Besmani Rights
Besmani retains the right to:
- Display completed work in portfolios, case studies, or marketing materials
- Reuse non-confidential techniques, concepts, or know-how
8. THIRD-PARTY SERVICES & TOOLS
The Client acknowledges that projects may involve third-party tools or services such as:
- Hosting providers
- Plugins, APIs, or platforms
- Advertising networks or software
Besmani is not responsible for:
- Third-party service changes
- Downtime, pricing changes, or policy updates
- Issues caused by third-party providers
9. CONFIDENTIALITY
Both parties agree to:
- Keep confidential information private
- Use confidential information solely for the purposes of this Agreement
- Protect sensitive data from unauthorized disclosure
10. CANCELLATION & TERMINATION
10.1 Client Cancellation
The Client may cancel services by written notice.
Payments for completed work are non-refundable.
Work already performed will be billed accordingly.
10.2 Besmani Termination
Besmani may terminate this Agreement if:
- The Client fails to make required payments
- The Client breaches this Agreement
- The Client engages in abusive, unlawful, or disruptive behavior
10.3 Effect of Termination
Upon termination:
- All outstanding invoices become due
- Besmani is not obligated to deliver unfinished work
- Client access to services may end
11. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
- Besmani is not liable for indirect, incidental, or consequential damages
- Liability is limited to the amount paid by the Client for the applicable services
- Besmani is not responsible for business losses or missed opportunities
12. INDEMNIFICATION
The Client agrees to indemnify and hold harmless Besmani from claims arising from:
- Client-provided content
- Misuse of deliverables
- Violation of laws or third-party rights
13. MODIFICATIONS TO AGREEMENT
Besmani may update this Agreement at any time.
Continued use of services constitutes acceptance of the updated Agreement.
14. GOVERNING LAW & JURISDICTION
This Agreement applies worldwide and is governed by the laws of the State of California, United States, without regard to conflict of law principles.
Any disputes shall be resolved in the courts located in California, unless otherwise agreed in writing.

By placing an order, confirming a payment plan, or clicking “I Agree”, you confirm that you have read, understood, and accepted this Customer Service Agreement.
